Vote Virginia and Louisa: Early Voting End Oct 31

No time to mince words.  I’ve told family and friends that the most dangerous period in our lives as a nation will be between the first Tuesday in November and Jan 3 next year.  The trickster in the White House has much up his sleeve should the Republicans lose control of the House and the Senate. I fear that there will not be a peaceful transfer of power in January.

With less than two weeks before November 3, polls show Democrats leading in many races, close in others.  Some decidedly red districts are also in play.   There is an excellent chance that Democrats will retake the House and even the Senate.

Trump’s domestic and foreign policies are a disaster. Trump’s tariffs, failed Iran war, and gross mistreatment of everyday immigrants have misfired with most Americans. Folks are just plain angry at the Republicans because they have wrought a slumping economy for working class folks; inflation continues to rise since Trump took office; diesel prices have surged to record highs; gas was below $3 a gallon now it hovers at $4; interest rates skyrocket for credit cards, car loans, and mortgages.  No wonder Trump’s approval rating is in the low 30s.  

While he is not on the “ticket” he is on the ticket.  Democratic donations are soaring, usually an indicator of voter enthusiasm and historically the party in power gets a comeuppance during the mid-terms.  Republicans on the other hand are relying on billionaires to fund their candidates and are in panic mode.

Every day it seems Trump and the Republicans get more looney and desperate.  Kicking the press out of the White House; diesel deals with Putin; overt bribes (remember the $5k promise, $90 dollar social security checks, $500 Afford Care Act “rebates,” $8 billion to farmers to offset diesel prices); threats to arrest election officials in various states and cities; A DHS search warrant executed on a sitting member of the House of Representatives over alleged citizenship fraud (she was a child of 17 when naturalized); arrests of supposed illegal voters in California; U.S. Post Offices seizing ballots or refusing ballots.  The list goes on and on.

How desperate will Trump get?  That is the million-dollar question.  We know at a minimum Trump will claim massive fraud and challenge the results and open criminal investigations.  The DOJ will go to court to get search warrants to seize ballots and voting machines in select districts.  From there, there is a high likelihood, that Trump will escalate. This includes:

  1. Declare a national emergency for alleged election interference by foreign powers (China, Ukraine) in collusion with democrats,
  2. Order the FCC to shut down ABC, CBS, NBC, PBS and radio stations,
  3. Order his tech bros to slow down, gum up, or block social media accounts on their platforms,
  4. Invoke the Insurrection Act,
  5. Declare Martial Law,
  6. Suspend Habeas Corpus.

We know in our hearts that Hegseth and Patel and Mullins will do whatever violence Trump demands to overturn unfavorable election results.  I think and hope they will be in for a rude surprise when everyday FBI agents, DHS agents, and service members say, not only “no,” but “Fuck no” to the illegal, immoral, and heinous orders they are likely to receive as Trump spirals out of control.  We must be prepared for this day, a day I hope will never come.

Time is short, get out and vote early.  Early voting in Virginia ends Oct 31.  After that day the next opportunity to vote is election day Nov 3.  The last day to register to vote is October 23.  So please, register to vote if not already registered, and get out and vote.  The more overwhelming the democratic vote, the less likely Trump and his henchmen will do the things listed above.  

This election is a vote for more than how we fair in this Trump economy, this is a vote to restore our democracy.  A vote against John McGuire and all of Trump’s endorsed candidates is a vote to save our democracy. Time to take back the House, the Senate, and the Rule of Law.

V is for Voting

Famously, presidential candidate Bill Clinton posted a reminder note that said, “It’s the economy, stupid.”  A cue that wonky policy sound bites or nuanced discourses on the pro and cons of a particular policy only go so far with the average voter.  For most voters, it comes down to kitchen table issues:  

Can I pay the mortgage or rent? 

Can I feed my kids?

Can I afford a middle-class life?  

They measure these questions against the previous few years:  Am I better off today than I was four or two years ago?

For conservatives and Republicans, continuing failures to successfully manage kitchen table issues – remember 2008 and 2020, the Great Recession and then the COVID pandemic – brought them down a path to embrace the most divisive candidate, and then President, in modern American politics.  Kitchen sink issues were replaced by xenophobia, homophobia, Islamophobia, gynophobia and its corollary misogyny, and racial animus.  

The basic kitchen table question must be revived.  Am I, and the people of Louisa, better off today than they were January 20, 2025?

I say, “No.”  The people of Louisa are worse off by most kitchen table measures.  

Louisa’s farmers are hard hit.  High diesel and gas prices, record fertilizer costs combined with low prices for commodities, and disappearing lucrative foreign markets, like China, are crushing Louisa, and American, family farmers.  This is the result of Trump’s misguided tariff war with China.

While unemployment remains at 3.9 percent, core inflation continues to shrink paychecks.  Wage shrinkage from inflation continues to be a self-inflicted wound.  Trump’s economic nationalism, which includes steep tariffs on most countries, continues to drive inflation up and shrink real wages.  

The disastrous never-ending war on Iran continues to keep gas at over $4.00 a gallon and diesel at over $5.00.  Borrowing money is increasingly costly as investors sour on America’s ten-year bond, raising interest rates for mortgages, credit cards, car loans, and small farm and business loans. 

Food Insecurity: The Louisa Resource Center Council’s Food Bank has seen record numbers of visitors, I learned, over the past year.  Louisa County Public Schools this  summer — starting June 8 — began a summer school age nutrition program serving meals at various locations throughout the county. The meals are free of charge, and available for any child ages 2 to 18. No ID is required. This program speaks to the ongoing food crisis for vulnerable children in our county. How is it we have the first trillionaire, yet our children go hungry?

Housing costs in Louisa soar:  Housing costs have been increasing for well over a decade.  The median sales price for a home in Louisa is $445k, up from $234k a decade ago.  The price per square foot, however, increased close of 6 percent over the past year.  This is a huge rise, directly correlated to Trump’s tariffs.  His recent 50 percent tariff on Canadian wood products, will only make matters worse regarding affordable housing.

Access to health care continues to shrink: Deep cuts to Medicaid and Medicare subsidies and the elimination of the Affordable Health Care Act premium subsidies have left many folks in Louisa County with no health care or delayed health care, many of them vulnerable children.

Meanwhile, as the denizens of Louisa pay the price for Trump’s mismanagement of about everything he touches, he and his family have profited to the tune of $2 billion dollars, mostly in the dark world of crypto currency.  The swamp he promised to drain has turned into a deep sea of corruption.

You can also frame the “are you better off today” question in terms of our democracy.  Is America’s democracy better today than it was before January 20, 2025?

I think most Americans would respond with an emphatic “No.”

By most measures, America is backsliding from the hallmarks of liberal democracy:  Pluralism, the rule of law, a healthy civil society, a government with three coequal branches, government transparency, equal access to voting and representation in government at local, state, and federal offices.

Sustained attacks on America’s institutions such as a non-partisan civil service, an apolitical military, Congressional powers, the federal courts, an independent justice Department have severely degraded America’s 250-year experiment.

Our Justice Department has become so rotten that a man was arrested and charged with vandalizing the Lincoln reflecting pool just to support Trump’s claims that his embarrassingly botched reflecting pool make over was sabotaged.  Prosecutors lied to and mislead the grand jury that indicted him.   This is what dictators do.

Despite all these challenges and threats to our democracy, we must still care …. and take the time and effort to vote.  The Democratic primary is this coming Tuesday, August 4.  Get out and vote for one of the three Democratic candidates for our district (Tom Perriello, Rob Tracinski, and Suzanne Krzyaowski).

As for this November, Rep. John McGuire (R) must go.  He has done nothing over the past two years for the folks of Louisa County or the 5th Congressional District.  His main job has been to kiss Trump’s big, beautiful orange ass. His legislative achievements for Louisa: a ‘big fat nothing burger’ as right-wing influencers are fond of saying.  Mostly culture war stuff.  He did vote for the big, beautiful bill, however, which crushes Medicaid and Medicare services to Louisa’s poorly paid working class and her seniors, and refuses to reign in Trump’s never ending illegal war with Iran.  As for Louisas farmers, he has been a big fat zero.  

Seems he is more interested in the stock market as he bought Nvidia stock twice this year and other stocks that his House Committee assignments oversee.  Once a couple of weeks after Trump purchased his own Nvidia shares.  Hmmmm?

Now, as we near the November mid-terms, Trump is increasingly signaling he will not accept the results.  He is positioning the Justice Department, the country’s intelligence services, and the Department of Homeland security to support his claims of fraud.  Will the military stay above the fray or go all in with Trump? What will the Supreme Court do?  

This raises the very serious question that are on many minds.  Will there be a peaceful transfer of power after the mid-terms?  Voter turnout this November must be huge. A democratic win must be overwhelming. Not by one or two points but by tremendous majorities.  Trump won’t dare to challenge a massive electoral loss, especially in deep red counties and states.  At least I hope he doesn’t.  But he is crazy, and not all there, so who knows.  If he does, then we must be prepared take a different tact, massive civil disobedience in coordination with court action. 

So, ask yourself, and ask your family or friends, are we better off today than we were in January 2025?  No. So, let’s get out and make our voices heard next week and in November. 

Screwworm:  Putting the Screws to Texas and John McGuire

Screwworms infestations were detected in Texas recently, according to media and government reports.  The screwworm, known as the New World Screw worm, is a fly that lays eggs on open wounds, for instance on livestock, that then grow into flesh eating maggots.  It can be fatal if not treated.

The screwworm was eradicated from the U.S. in the 1960s.  For decades, the U.S. worked to keep the screwworm at bay, working closely with Mexican and Central American governments.  This included the U.S. government funding facilities to produce and distribute sterile flies, for instance.  In 2023, the screwworm started migrating north again, probably climate change related, no?  As a result of further northward migration, a ban importing cattle from Mexico was recently put in place.  This is a key contributor to the shortage of beef cattle in the U.S., in fact, a 75-year low.  

If the screwworm infestation becomes more widespread in Texas, the state could suffer close to $2 billion dollars in economic losses.  Canada banned livestock imports from Texas temporarily.  A 1976 screwworm outbreak in Texas caused economic losses between $700 million and $1.8 billion in 2024 dollars, according to a Congressional Research Report submitted as part of a bill introduced in 2025: H.R. 3392 (more on that bill a bit later). 

The response to the new infestation has been, to say the least, interesting.  Texas ranchers are blaming the federal government for being too slow to respond.  Yep, the same Texas ranchers I suspect who voted for Trump, once, twice, and most likely thrice.  They, I would imagine, cheered on the DOGE cuts to USAID and USDA, two agencies that are instrumental in programs to contain the screwworm south of the border. Things could have been different, but ….

On May 14, 2025, Texas Republican Tony Gonzalez introduced the “STOP Screwworms Act” in the House of Representatives.  H.R. 3392 required the Secretary of Agriculture to “establish a New World Screwworm fly rearing facility, and for other purposes.”  It never got past being introduced, much less become law.  It was a bipartisan bill, with over 50 cosponsors.  The same CRS report mentioned above outlined the devastating impact an infestation could have on Texas and other border states if no action was taken.  

The failure of this bill to pass and become law illustrates how screwed up and incompetent the House of Representative is under the control of the Republicans and Speaker Johnson. Not to be outdone, the current Trump appointed Secretary of Agriculture blames, wait, wait, wait….. Biden and open borders.  The cattle ranchers aren’t buying it.  

Some ranchers have proposed self-funding screwworm eradication programs given the federal governments slow and incompetent response. You know, you get slow and incompetent when programs are defunded, scientists hounded out of government service, and all sorts of other stupid stuff.  

Meanwhile, as the screwworm infestation gets worse, our President keeps a razor sharp focus on……the reflecting pool, his billion-dollar ballroom, and his birthday bash UFC fight at the White House’s Thunderdome.   Texans.  What the hell did you think was going to happen?  It’s your own damn fault.

Another thing that irritates me is that when there was a 2025 measles outbreak in West Texas that infected close to 800 kids, of whom about 100 were hospitalized, and two died.  All hell should have broken loose, but no.  Texans seemed to shrug.  Fits the anti-science, anti-vaccine, anti-government ideology of Texas. Trump’s Secretary of Health and Human services blamed the vaccines and suggested suspect treatments.  Where was the outcry?  I guess you all like your cattle more than your kids.  About 70 percent of kids are vaccinated in Texas, that is below the national average.  

Come on Texas, you can do better.  The federal government’s slow and haphazard response should be a warning to farmers and ranchers that still support Trump, in Texas and my home state of Virginia.  He’s not your friend.  Do you trust a politician whose hands have never touched dirt, or had a callous, or owned a dog, or got up before sunrise?  

But, I imagine you’re busy trying to find buyers for soybeans and corn crops you planted and worrying whether you can afford the diesel fuel or fertilizer as Trump’s incompetent and haphazard war of choice with Iran drags.  You farmers and ranchers all need some “straight” talk and tough love at times:  You screwed yourselves.  

This November, put a stop to the chaos. Make Congress vote for you and not Trump. Vote for Democratic candidates and family farmer friendly policies, not for corporate farm monopolies.  

John McGuire, our representative, has not introduced or sponsored one bill to directly help the farmers of his district. He doesn’t serve on any farm or agricultural subcommittees.  He did vote for two key bipartisan farm bills, however, which included funding for a new fire truck for Louisa County and monies for the Nottoway Sheriff’s office, hardly direct help to our farmers here in Louisa.  He did sponsor a bill to “Make the District of Columbia Safe and Beautiful” in 2025.  

The sugar farmers love him it seems, as he gets campaign donations from them and their associations.  For instance, the America Sugar Cane League, the Michigan Sugar Growers PAC, and the Sugar Growers Cooperative Florida.  Do we even grow sugarcane in Virginia?  Did I mention he has been buying Nvidia stock this year?  Twice (January and May).

Break Glass in Emergency: Vote Yes by April 21 in Virginia’s Redistricting Referendum

If things were normal, which they are not, I would oppose returning the drawing of Virginia’s congressional district maps back to the state’s legislature, even temporarily.  America is in deep trouble, however. Democracy is in retreat; the country is ruled by decree out of the White House. Congress sits mute.  A President ruling from his gold encrusted throne threatens to “nationalize” the elections and seems indifferent to his paramilitary police brutalizing communities and shooting and killing citizens.

The Constitution – our written social contract as to how the government is organized and how power is shared – is shredded day-by-day by Trump.  Our representative in the 5th District, John McGuire just voted for the Save Act to make it harder for Americans to vote and agrees with Trump’s call for Republicans to nationalize the vote, or at the least, has not repudiated Trump’s demand.  He thinks he works for Trump and not we the people of his district.  It is time to fight back, it is time to b break the glass because there is a constitutional emergency.

The fastest and best way to check Trump’s unchecked power is by electing Democrats to the House of Representatives – the people’s house – and the senate.  Sensing a coming defeat this November and a loss of a Republican majority in the House of Representatives, Trump demanded that red states redraw their congressional districts, immediately.  If you can’t win fair and square, cheat, lie, and steal is this administration’s mantra.

Texas obliged instantly, without consulting their people.  Another example of rule by dictate far too common in red states.  At least the people of California had a choice whether to redistrict (they voted ‘yes’ this past November).  We the people of Virginia will have our chance to give voice to whether we redistrict.  That vote is April 21.  Early voting starts March 3.   

Democrats did not ask for this redistricting fight, but Trump threw down the gauntlet.  We the people of Virginia must take drastic steps to reclaim sovereignty or lose our democracy to one-party rule and dictatorship. 

Vote YES to temporarily redistrict Virginia’s congressional seats.  

For those constitutional law geeks like me, below are some Frequently Asked Question:

How many other states are redistricting (or counter redistricting) based on Trump’s outrageous demand?

According to the National Conference of State Legislatures, five states have already redistricted (Missouri, North Carolina, Ohio, Texas, California); A number of states have introduced legislation to redistrict (Maryland, South Carolina, Washington, and Virginia):  Florida is in the process of adopting legislation with additional states contemplating redistricting, but awaiting state court decisions (Alabama, Louisiana, North Dakota, and Wisconsin).  Other states have already moved forward and many plan to do so.  Indiana rejected Trump’s redistricting demand.

Why does Virginia need a vote on whether to redistrict its congressional districts?

In November 2020, Virginians voted overwhelming (66 percent) to amend the state’s constitution to appoint a 16-member bipartisan commission to draw Virginia’s congressional districts.  Virginia is one of about a dozen states that have independent commissions to draw congressional maps.  A majority (29) still permit their state legislatures to draw congressional districts.  The referendum vote in April is the only constitutionally sanctioned method to temporarily amend our state constitution so that the Generally Assembly can redraw Virginia’s congressional districts.  

Why hasn’t the Supreme Court ruled that partisan redistricting is unconstitutional?

They did rule, by not ruling.  They took the easy way out and said it was out of their hands, that there were no ‘judicially discoverable’ or ‘manageable standards’ to adjudicate claims of unconstitutionally drawn districts, with one exception, drawing districts to favor white voters (e.g., diluting concentrations of black or brown voices into majority white districts).

A brief recent history:  In 1986, the Supreme Court ruled that the federal courts could hear challenges to how congressional districts were drawn, however, the court offered no standards.  Some years later in 2004, the Supreme Court ruled there were no “judicially discoverable or manageable standards.”  The conservative court inches it way toward legalizing partisan gerrymandering.

In 2019, in Rucho v. Common Cause, the Supreme court ruled that federal courts could not hear claims of partisan gerrymandering because they – the court — could not articulate any standard by which to judge partisan gerrymandering.  Out of very thin air, they could invent the legal fiction that President Trump is immune from crimes committed for official acts, but these Harvard and Yale legal brains are damned clueless as to how to fix the scourge of gerrymandering.  This legal punt basically legalizes partisan gerrymandering no matter how egregious, at least at the federal court level.  State courts can still hear cases, nonetheless.

To make matters worse, the Rucho decision gave states a “partisan” get-out-of- constitutional jail card for race-based gerrymandering.  In 2024, South Carolina drew racially gerrymandered congressional districts.  The South Carolina NAACP sued.  South Carolian argued it was not racial gerrymandering, but ‘partisan’ gerrymandering.  In a 6 to 3 decision, the Supreme Court agreed with South Carolina and let the racially drawn maps stand.

After Texas redrew its congressional districts after Trump requested it do so, The League of United Latin American Citizens sued.  A federal district court, after 9 days of testimony and review of thousands of documents, concluded that Texas illegally redrew the congressional districts based on race.  In a shadow docket ruling, however, the Supreme Court, overturned the district court and said Texas could use the newly drawn maps.  

The reasons given by the Supreme Court’s were: 1) The District Court failed to “honor the presumption of legislative good faith;” 2) The District Court did not produce a viable alternative map; 3) It was too close to the election to redraw the redrawn congressional maps.   My only response:  What the fuck!  I did not know there was a ‘legislative good faith’ exemption to unconstitutional laws.

So, there you have it.  Go out and vote. And vote Yes.  

The Good, the Bad and the Ugly

For three plus years my wife and I were volunteer repair program managers for Charlottesville’s Habitat for Humanity program in Louisa.  The repair program primarily focused on ensuring folks could safely get in and out of their homes.  This included repairing or replacing decks or stoops and stairs, replacing or repairing exterior doors, installing ramps.  We also replaced or fixed window, siding, soffits, gutters, and the occasional roof.  The work was all done by volunteers.  One year I put 2500 miles on my truck supporting Habitat projects, which reflects the demand for housing aid in Louisa County.

Whether or not a project went forward after the initial survey and scope of work was completed, depended on the client’s income.  They had to make at or less than 50 percent of the average marginal income for the county.   Our typical client was female, over 65, widowed, earning between $8 to $24K per year.  The bulk of that from Social Security.  To say the least, they struggled to keep maintain their homes.  Most had worked their entire adult lives yet have economically drifted downwards into poverty once they can work no longer.  

No defined pensions, marginal savings if any.  The only wealth they have was tied up in their home and land, but without being able to maintain the home or land, its value shrinks.  Given the absence of affordable housing in the county, the elderly who want to maintain their independence and local connections have two basic choices:  Sell and move out of the county or stay in a decaying home.  The Fluvanna-Louisa Housing Foundation is working solutions for this conundrum of Louisa’s elderly, pulling an indifferent Board of Supervisors along with it.

The reasons for the statistic regarding our primary clients are myriad, but three primary causes stand out. Women tend to get paid less than their male counterparts, even if they worked the same job. This continues to this day.  Additionally, women of the generation we tended to work with were limited to careers they could work in, which in many instances, were lower paid.  Finally, during childbearing years, women usually had to quit work or take long periods of unpaid leave.  A triple whammy. Social Security benefits are tied to one’s annual income and lifelong earnings.  So, after decades of work and sacrifices, women tend to have accumulated less Social Security benefits and retirement savings.  Their reward?  Poverty.

The ‘big, beautiful bill’ will add misery to the county, especially to our elderly on fixed limited incomes.  For instance, our elderly clients typically pay Medicare premiums out of their Social Security benefits.  For those that cannot afford Medicare premiums, which I imagine were most of them, there used to be financial assistance through the Medicare Savings Program (MSP).  The beautiful bill cuts or eliminates assistance.  The MSP cuts could force enrollees who earn less than $24K a year to pay an additional $3000 out of pocket for Medicare premiums, potentially $8k if a couple.  Our average client will be devastated economically, to say nothing about the impacts to their health care should they lose Medicare insurance, such as access to prescriptions.  

Speaking of health care, cuts to Medicaid will indirectly impact access to health care for the elderly in rural areas such as Louisa.  Rural hospitals and clinics rely on Medicaid payments to stay in business. Less income will result in closures.  About 17 percent of Louisa residents rely on Medicaid.  Louisa is already a medical care desert as it is, and it will get worse after this bill.  No hospital, no public health clinics (except for Central Virginia Health Services, a non-profit group), and no private urgent care type facilities (not profitable enough for them to come to Louisa).  I imagine that the number of doctor offices we do have will shrink.

Shifting money to the wealthy.  The bill does provide for a senior tax deduction.  If you earn more in income benefits, you can claim a larger tax deduction.  For instance, if you are 65 or older, earn up to $75K, these folks can claim a $6500 tax deduction.  Our typical client would not benefit from this tax deduction at all.  

This senior tax deduction is another way of transferring wealth to older, wealthier folks, and short shifting the young.  Contrast the $6500 senior tax deduction with the $200 dollar increase in childcare tax deduction from $2000 to $2200 per year.  I thought we loved our children.  In Virginia, the average infant childcare cost is $14k per year, about $11K for a four-year-old.  Overall, these types of tax breaks will accelerate the depletion of the Social Security Trust Fund.  Basically, now 2033.  

The bill is big, but it is not beautiful, it is damn ugly, like the spaghetti western, the good, the bad and the ugly.  Mostly the latter two.  It attacks the poor, marginalizes working class women, and transfers immense wealth to the upper classes, leaving many to struggle mightily for safe housing, food security, and access to health care.  About 60 percent of the bill’s financial benefits will go to 20 percent of the population.  12 million folks will lose access to health care insurance.  Millions of working-class folks will lose access to food aid because of “paperwork barriers” designed to reduce the number of enrollees.  Yet, with these “savings” we are going to build a police state through $150 billion in increased funding for DHS agents and a trillion-dollar defense budget.  

Our 5th Congressional District representative John McGuire voted for the bill and issued an ingratiating, bootlicking, suck-up press release fit for North Korea, not America, on the cusp of 250 years of independence from Kings. Like a sucker fish on a shark, McGuire is attached to Trump’s big, beautiful orange ass.

As part of nation-wide Hands Off protests and rallies, residents of Louisa, Virginia, assembled at the Court House steps this Saturday to add their voices to a growing chorus across America, and the world, excoriating Trump’s attacks on democracy.

Organized by the Louisa County Democratic Party, the rally was one of the largest gatherings, as I understand it, in memory. The diverse and enthusiastic participants focused on wide ranging issues: Constitutional rights, Education, Healthcare, Human and Civil Rights, Immigration, Justice, LGBTQ rights, Social Security, and Veteran Services. This wasn’t a one issue rally.

Speeches, songs, and chants filled the Court Houses front steps from noon to two. Homemade signs expressed patriotism and anger. A number of speakers derided Trump’s attacks on democracy and also on our congressional district’s representative John McGuire (R) lack of honesty and integrity in the face of constituent questions.

Speakers repeatedly called to protect social security, medicare, and medicaid –which assists Americas most vulnerable populations — from being cut to fund trillions in taxes cuts for the millionaire class. Boos and catcalls followed mentions of Trump’s tariffs. One speaker addressed the serious threats to veterans and their health services because of massive layoffs and program cuts at the Department of Veterans Affairs. Trump, Musk, and McGuire the villains of the day.

A number of participants volunteered to speak to the assembled crowd. One told of his still living mom’s experiences in Nazi occupied France — she was 11 when they invaded — and her fear that America is heading towards fascism. I can relate to that as my mom and her family lived under Nazis occupation as well. She sees parallels today.

A dear John Letter: A Response to a Letter from Representative John McGuire

Below is a response to an email I received from Virginia’s 5th Congressional District Representative John McGuire. It was written in response to a letter or email I sent to him. I am appreciative and grateful for his response. I expected it would be one of those form letters, pandering and short on substance.

To my delight it was long, specific, and expressed his world view and take on recent controversial actions by the Trump administration, in particular the alleged unlawful deportation of hundreds of alleged Venezuelan gang members to El Salvador’s maximum security prison. To my dismay, it demonstrates a fundamental break in who is and who is not entitled to basic constitutional rights.

The letter below is my response. I will mail him a hard copy.

Dear Mr. McGuire:

Thank you for your email dated March 28, regarding the recent deportation of hundreds of Venezuelans alleged to belong to a criminal gang to an El Salvadoran maximum security prison. I appreciate your candor and directly addressing my concerns. However, I would like you to consider some of my observations regarding your response. They are based on my 29 years of federal law enforcement experiences.

In your letter you stated that “Law enforcement spent weeks drafting the list of deportees to make sure all were connected to the violent Venezuelan Tren de Aragua gang.”  Adding, that if some were mistakenly identified as a gang member, it really didn’t matter because they were in the country illegally: “I am aware there has been some discourse surrounding whether all those deported were connected to Tren de Aragua. I have full faith in our law enforcement, but on the rare chance that some of those who were deported happen to not be gang members they were still here illegally and therefore have committed a crime.”   

I would rather have 150 guilty men go free than imprison 50 innocent men.  It is cruel to send someone who would maybe get six months in a U.S. minimum security prison, than an indefinite stay at a high risk maximum security prison in El Salvador. Cruel and unusual punishment don’t you think?

What you didn’t mention is that despite a Federal District judges order to stop the deportations and return the flights pending hearings for the deportees, the government deported them anyway.  Claiming they were over ‘international waters.’  How could this be if they were over the Gulf of America?  

I believe your claim that you venerate our Constitution, but you seem unaware that our great Constitution has a Habeas Corpus clause.  That is the government must produce “the body” in a court so that the defendant has a right to challenge the charges and their detention.  Basically, that their arrest and confinement were legal.  This fundamental legal concept goes all the way back to the Magna Carta.  That is an 850-year-old tradition bequeathed to us by the British.  And Trump throws it out like yesterday’s trash.  The Judge’s order to stop the deportation was basically a Writ of Habeas Corpus in name and spirit.

I think we can both agree with the proposition that all inhabitants of the United States, regardless of citizenship or immigrant status have the following basic, fundamental human rights we cherish as a nation:

  • The presumption of innocence
  • To be secure from unreasonable searches and seizures (an arrest is a seizure)
  • The right to counsel
  • Right to a speedy and public trial
  • Not to be deprived of life, liberty, property, without due process of law
  • Not subjected to cruel and unusual punishment

The Venezuelans, it appears, were denied every one of these rights enumerated above. I am curious then, why you think these rights do not apply to them?

The arrests and deportations of these Venezuelans is the exact opposite of how our judicial system is supposed to work. The law enforcement agency making the arrests – the ones you have ‘full faith in’ – are not the prosecutor or the judge or the jury.  Our system is designed to be adversarial, where the government must present evidence, to either a grand jury or magistrate before an arrest is made; or, after a warrantless arrest brought before a judge, and in the end convince a jury.

Even the basic right to challenge the government’s assertions of either criminality or being in the country illegally, was denied the Venezuelans, it appears.  From what I can gather, the government presented no evidence.  The court decides whether their detention is legal not ICE or you or Trump.  I can see the discussion now:  Judge, “What proof do you have that the defendant is a gang member?” Agent: “He has gang tattoos.”  Judge: “WTF! Get out of my Court.”  And it goes downhill from there.  

Tattoos? That would be like rounding up everyone who was near Capitol Hill on January 6 wearing a red MAGA hat and deporting them to Guantanamo without due process.  Don’t you think?

Spuriously invoking and using the Alien Enemies Act of 1798, the government denied their rights, disappearing them:  No due process, no right to counsel, no hearing before a judge, sent to prison in El Salvador without trial for indefinite detention.  That should scare the crap out of everyone.  Then, to top off this charade of justice, DHS Secretary Noem shows up in El Salvador for a photo opportunity.  Thank God there were not gravel pits nearby.

I know I can be pedantic about American history, but did you know that the Alien Enemies Act can only be invoked after a declaration of war?  I really, really, really, hope you are aware that only Congress has the constitutional and legal prerogative to declare war.  The President’s use of the Alien Enemies Act was therefore illegal, extra-Constitutional.

You and I both swore an oath to preserve and protect the Constitution. I did my best to uphold that oath and I expect you to faithfully execute that oath for the people of Virginia’s 5th Congressional District.  It’s your duty to challenge these trespasses and gross injustices by Trump, not excuse them.

Listen, I am not against deporting criminal aliens and believe in protecting our borders. One of the last cases I oversaw resulted in a child sex trafficker getting 25 years in federal prison. But let me ask you this, why protect our borders when a sitting president destroys the country from within by attacking the fundamental rights we agree are essential to this great country’s democracy? When police ‘gather lists’ at the direction of political leaders we are in dangerous territory. Whatever you think ails this country, strangling democracy to save it is not the right answer.

Lost and Found: Where in the World is John McGuire

Yesterday, the House of Representative’s DOGE Subcommittee, chaired by Marjorie Taylor Greene, provided a WWE style smackdown of senior executives from National Public Radio and Public Broadcasting Service.  The usual theater, chair shots, kissing up to Fox News, bullying, the outcome preordained. 

John McGuire, Virginia’s 5th Congressional District Representative, and a member of the DOGE Subcommittee was nowhere in sight.  Maybe he was teleworking?  He did not make an appearance (from what I can tell) much less ask any questions.  In an almost 3-hour hearing you would expect him to show up and ask a question or two.  He didn’t.  Was he getting his nails done?  Maybe he was on some Signal group chat. The dais where the representatives lord over the witnesses was mostly empty throughout the hearing, although I must admit, that there were more chairs than members on the Subcommittee.

It was an important hearing.  It was federal funding life or death for NPR and PBS.  Looks like death.  If the Subcommittee had its way, according to Greene, they would never get another penny of taxpayers’ money.  McGuire, I suspect would agree with the Subcommittee’s sentiments.

What galls me is that federal workers have been excoriated for allegedly not showing up for work or being lazy or wasteful, by folks like McGuire.  Justification for purging tens of thousands from federal government payrolls. The usual claptrap.  So, where was he on Wednesday?  My tax dollars, and your tax dollars, pay his salary, and I expect and demand him to put in the time and show up for committee hearings, ask questions when important issues are being discussed.

Please call or write Mr. McGuire and ask where the hell he was yesterday and why wasn’t he at the hearing to ask questions.  Finally, tell him to support NPR and PBS if you are so inclined.

Lead, Follow, or Get Out of the Way

This past Sunday Democrats held an innovative multi-county town hall meeting in Goochland County, Virginia.  The invited guest, Rep. John McGuire (R), who represents Virginia’s 5th congressional district, did not accept the offer to speak to his beloved constituents.  In his place stood a cardboard avatar of McGuire, sporting a long, long, long, red tie, cartoon speech balloons emanated from his head. It reminded me of 18th century satirical political cartoons by William Hogarth.  

It was standing room only, a spirited, eclectic gathering.  Most were women, a good number of veterans, and a few former Republicans sprinkled among us. A microcosm of rural America: farmers, veterans, small business owners, local government employees, a few ministers, a good show of teachers, retirees, and some young’uns.   Some were in their Sunday best, either coming from or going to Church.  

McGuire’s replacement avatar and speaker was a civil rights attorney from Albemarle County.  After introductions he took questions and offered observations about McGuire and directly addressed Chuck Schumer’s about face on the Continuing Resolution to fund the federal government.  I think his comments reflected the general mood of the crowd: anger and frustration at Schumer.

The overall tenor of the questions asked was one of concern, fury, and annoyance at Trump and Musk.   These concerns, anger, and frustration were not reserved only for Trump, but at national Democrat leadership in Congress as well:   Where is it?  What’s the opposition strategy?  If you did a word count of participants comments, I think “fight” would be at the top of the list.  The verb, not the noun.

My takeaways from the town hall are that folks are not only worried about Trump’s reckless assault on our Constitution but also troubled by the lack of a will to fight and take risks by national Democratic Party leadership.  Schumer’s about face and capitulation, being Exhibit A.   The lack of an articulated strategy to respond to the erosion of democracy being Exhibit B.  No mid-term election plan, Exhibit C. 

It seems folks feel rudderless in a tempest, watching the ship of state drift closer to the shoals, the captain nowhere to be found, lifeboats swept away.  I imagine leaders in local Democratic party organizations are themselves frustrated at the national leadership.  I see the fatigue in their eyes and hear it in their voices. They are leaning hard into the the headwinds trying to thwart our democracy. They deserve better from national leadership.

I get the sense that folks desperately want to participate in meaningful opposition but only have timeworn responses in their tool kit:  write letters; email or call your representatives; show up for town halls; boycott businesses that support Trump.  These measures seem futile, like using little adhesive band aids when one needs a trauma kit, a tourniquet to keep America’s democracy from bleeding out. 

When I found out a day or two after the town hall that Schumer cancelled his tour to hawk his new book because of security reasons, my first thought was, ‘book tour?” WTF? Really, Rome is burning, and he is going on a book tour.  What doesn’t he get?  It just highlights that the intellectual framework that guides his notion of being a Senator is dated, like orange shag carpets and lava lamps.  He clings to a nostalgic past to the detriment of our future. 

No need to hit the panic button, but time is not on our side, given Trump’ frantic pace to undo democracy. The mid-terms are too far off to make any real, immediate course corrections.  The national Democratic Party leadership needs to get off its’ ass.  Trust us.  We will do the right thing if given the chance, but it requires tough national leadership that is willing to take risks, carry the flag at the front.  At my infantry basic course our motto was:  “Lead, follow, or Get out of the Way.”  Mr. Schumer, get out of the way.     

Lifeboat:  A recap of John McGuire’s call-in Town Hall

Representative John McGuire of Virginia’s 5th Congressional District held a call-in town hall meeting recently.  I don’t know how many folks attended the town hall, but I do know that when folks were selected to ask McGuire questions the majority queried him about Medicaid cuts and DOGE. Funny, no talks of eggs.

McGuire started the town hall by asking listeners to participate in a poll.  The first question was, “do they want to root out waste, fraud, and abuse? “ That’s like asking Medieval folks if they want to root out Black Death, the plague.  Of course they did.  It’s the methodology that they had quibbles over.  In 17th century England, if a household member got plague, the whole household was locked inside the house for 30 or 45 days, a guard posted outside.  That quarantine was extended as other household members sickened and died.  Normally, everyone perished.  Sounds a bit like DOGE’s methodology regarding USAID and lifesaving anti-viral drugs for millions of Africans. 

But back to the town hall.  The first question McGuire was asked sounded the alarm about the proposed $880 billion dollar cut to government agencies overseen by the energy and commerce committee.  This would entail massive cuts to Medicaid, the caller thought.  McGuire’s response was to happily, almost joyfully, point out that Medicaid was not mentioned once in the proposed budget blueprint.  Duh!  The New York Times reported that if the committee cut all other non-safety net programs under their oversight, they would still have to eliminate an additional $600 billion in funding.  That means Medicaid would be hit….hard.

Another caller, a preacher, pointed out that 24 percent of his district receives Medicaid.   I asked myself, did it ever dawn on McGuire to ask himself, “why do so many folks who work full-time jobs in my district can’t afford medical insurance or care? “ Piss poor wages dude!  Nationwide, over 64 percent of Medicaid recipients work.  In Louisa County, 17 percent receive Medicaid, and this is in a county where unemployment is just a smidge over 2 percent. According to Virginia law, if Medicaid expansion funding from the Federal government drops to a certain level, the program is abandoned.  Yes, abandoned.  That would mean 600,000 Virginians would lose access to health care, many of whom are kids.  Later callers, it was clear, weren’t buying McGuire’s Trumpian responses.

The same went for DOGE.  Near universal condemnation of DOGE’s chainsaw approach, many pointing out its cold-heartedness.  One caller, from the Charlottesville area, said folks in her organization – which she specified — were worried about the haphazard cuts and potential cuts to come.  In perhaps a Freudian slip, McGuire spoke of her position and organization in the past tense.   Which he corrected quickly.  I am sure that that slip was noted by listeners.

During overwhelmingly negative comments and questions regarding DOGE’s incompetence and draconian Medicaid cuts, McGuire’s aid interjected and offered an email question.  The email question was quite flattering of McGuire.  Really, were not dumb!

Overall, McGuire got an earful, but I don’t think he listened.  Too often he used rehearsed and prepared talking points (you heard papers shuffling) instead of genuine concern.  Given the tenure of other town halls I seen or heard about, I was surprised at how calm the questioners were.  Very civil, very polite, but direct as well.  McGuire was civil himself, but too often resorting to the same phrase, saying, ‘I still love you even though we disagree.’  

I think McGuire forgot a cardinal rule in politics:  He forgot who he works for.  We expect our politicians to omit and lie and obfuscate, but we don’t expect them to work against our interests.  It was obvious he works for Trump and not us.  Ben Franklin at the Constitutional Convention in Philadelphia in 1787 said it best I think:  “In free governments, the rulers are the servants, and the people their superiors and sovereigns.”

You may be wondering why Lifeboat” is in the title of this essay. I remember as a kid watching a black and white war movie telling the story of the survivors of a torpedoed merchant ship.  The drama takes place in the overcrowded lifeboat: too many people, not enough space, too little food or water.  As time passed people died or were killed.  I realized later with age and little bit of wisdom, that the lifeboat was a parable about class and society.  The passengers represented a spectrum of society:  a wealthy socialite, working class ship hands, upper class passengers, the young and elderly, a vulnerable woman with a dead child, an enemy portrayed by the German U-boat captain. Conflicts ensued as resources, and hope, dwindled.  Winners and losers.  Everyone dead or morally tainted.

That’s the paradigm that sticks in my mind when I think of politics in America today.  America the Lifeboat.  Billions, tens of billions in cuts to Medicaid and other safety-net programs — mostly to working class folks – to pay for $4 trillion in tax cuts, the bulk of the dollars going to the wealthiest Americans.   I think that’s not the ‘golden age’ most folks who voted for Trump envisioned or want.
