Trump’s personal battle of evermore with Harvard continues, with the administration banning foreign students from enrolling at Harvard and then a federal court issuing a temporary injunction.  Trump further ordered a freeze on all federal government contracts with Harvard, putting on ice about $100 million in funds.  This includes several hundred grants for medical research.

But who cares about real medical research when you can just make it up.  Health and Human Services Secretary Kennedy released a report on Making America Healthy Again (MAHA).  The report however, is riddled with problems, primarily that many scientific studies referenced in the report do not exist.  Yes, they were made up, fabricated.  Additionally, the FDA issued a statement opining that pregnant women and healthy children do not need COVID vaccinations.  Two issues, one, normally the Centers for Disease control makes vaccination recommendations, not the FDA, and two, pregnant women are at greater risk for bad outcomes from COVID infections, the science says.  Sadly, after Kennedy’s intentions were made clear, the CDC followed suit.  So, here we have it.  Science based policy decisions are thing of the past.  It’s Kennedy’s magical mystery tour.

The Department of Justice announced FBI investigations into several old closed cases. 1) They will reinvestigate pipe bombs left at the Democratic and Republican offices on January 6, you know the day Trump attempted a coup.  Conservative conspiracy theories are that the FBI planted them.  2) The Dobbs Supreme Court leak will also be reinvestigated.  My guess the “investigative results” it will be used to impeach one of the three remaining liberal justices. 3) During the Biden administration, a bag of cocaine was found and the FBI will reopen that investigation.   This follows previous weeks of charging a democratic house member with assaulting a federal agent, dragging former FBI Director James Comey before investigators for allegedly threatening Trump by posting a number on line: 8647, and investigate New York’s Attorney General Letitia James for mortgage fraud. 

Regarding foreign affairs, the U.S. Trade Court ruled this week that Trump’s global tariff regime was unconstitutional and that he overstepped his authority to issue such blanket global tariffs.  An appeals court promptly stayed the Trade Court’s ruling until that court can weigh in early June.  I imagine it will end up in the Supreme Court. It is anyone’s guess how that will end given the court’s propensity to hand over more and broader executive powers to Trump, basically fatally undermining the fundamental structure of separate and equal branches of government.

Meanwhile, Trump in a Friday missive lashed out at China for violating a ‘trade truce’ pending resolution of negotiations, which according to America’s negotiator, has stalled.  I imagine he will have TACOs for lunch later this week. This lashing of China comes on the heels of the administrations announcement that it was reviewing visas issued to China.  Trump is reimagining the America’s 19th Century “Chinese Exclusion Act.”  

Not to be outdone, Rubio’s State Department, announced a new policy targeting foreign government official that allegedly censor social media.  The intent of the policy is to target Brazilian Supreme Court Justice Alexandre de Morae, who has made rulings against the social media company X and Elon Musk.  This will no doubt alienate one of our largest partners in South America.  I guess Putin and Orban and other foreign government officials that censor social media will be target.  Just joking.  

Meanwhile, after condemning social media censors, the Department of State announced a freeze on foreign student visas pending the imposition of “expanded” social media reviews to detect anti-American or antisemitic posts.   I guess our censorship is a different type of censorship, no?  

In sum, Trump is picking a fight-to-the- death confrontation with Harvard, basically summoning all the coercive control levers of federal executive power.  As I see it, Trump thinks that if he slays Harvard, the rest of academia will quickly surrender.  He may be right.  I expect him to ratchet up the pressure in the coming weeks.  

China is another case of Trump tilting at windmills.  I understand our strategic need to address China as an economic competitor – one that is kicking our butts, especially in technology – and a potential peer military opponent, but I just don’t see a comprehensive, well thought out strategy.  For instance, on one hand he said he is imposing tariffs on China (and around the world) to bring manufacturing back to America.  Yet, in the ‘big, beautiful bill,’ all the billions in investments in American clean energy domestic manufacturing is being killed.  It makes no strategic sense.  

Trump’s policies and management of foreign and domestic affairs are helter-skelter, undisciplined, score settling, and a way to line his and his family’s pockets with millions.  An like a herd of wildebeests charging headlong in to a crocodile infested river, the Republican party follows.

It was an ugly week.  First and foremost was Trump’s vile and disgraceful racist spectacle directed at South African President Ramasphosa during a White House visit.  Given the long history of English and Dutch colonization and brutal oppression of black South Africans during the apartheid era, the false claim that white Afrikaners are being subjected to a genocide was shameful.  The supposed evidence — a video of white crosses — was from the Congo not South Africa.  This spectacle was the most openly white nationalist display by an American president since President Wilson screened “Birth of a Nation” at the White House in 1915. A movie based on the novel “The Clansman.”

The battle between Harvard and Trump escalated this week with the administration banning foreign students from enrolling at Harvard.   The next day Harvard filed suit, and a Federal Judge ordered a temporary pause on the administration’s action.  This escalation is another example of Trump’s use of ‘arbitrary terror’ to punish and discipline supposed adversaries. A hallmark of dictatorships. 

Trump also singled out Bruce Springsteen, Beyonce, and Oprah Winfrey for investigation, alleging violations of federal laws.  Without any proof, he accused them of accepting payment to endorse political candidates.  When Trump suggests an investigation, whether verbally or on social media, one of his willing cabinet members orders one.

When not accusing others of corruption, Trump hosted an event at his Washington Area golf club to reward top investors in his crypto coin $Trump.  The 220 top investors averaged around $1.8 million in purchases.  According to press reporting, since January Trump garnered over $320 million in fees from these sales.  Yep, $320 million in six months.  

Speaking of slimy, swampish, Trumpian corrupt practices, his majesty accepted a $400 million emolument from the Qatari crown prince in the form of a 747-luxury jet.  It will be used as Air Force One and then provided to Trump’s presidential library foundation for his personal use.  Given the overhaul required to ensure it is 1) air worthy, and, 2) not full of electronic eavesdropping devices, it will also require extensive renovations to install secure communications, anti-aircraft missile countermeasures, and hardening for electromagnetic pulses from nuclear detonations.  More of your hard-earned tax dollars going to feed Trump’s massive ego. Pure waste, fraud, and abuse.

On the criminal investigative front, following an incident at a New Jersey ICE detention facility, federal prosecutors’ charged U.S. House of Representative LaMonica Mclver with assaulting a federal agent.  James Comey, former FBI Director, was interviewed by the Secret Service for allegedly making threats to the president after posting a picture of seashells arranged to spell 8647.  ‘86’ being a code for killing someone allegedly.  However, if you look at the origins of ‘86’ it is a code for ejecting or barring some from a bar, or, to cancel, reject, discard something, per the dictionary.  

Also, the DOJ confirmed it is investigating New York’s Attorney General Letitia James for mortgage fraud. Must have turned over every rock of find that one.   Finally, the FCC announced a probe into Media Matters, a liberal advocacy group.  This based on Elon Musk’s accusation that the group colluded with advertisers to boycott X for racism.  Meanwhile, Mohammed Khalil and Abrego Garcia still sit in jail.

Before turning to some positives, I think the whole Biden fiasco needs a few short words.  What was the democratic party leadership thinking?  We don’t need a book to tell us what we all knew.  It wasn’t Biden’s age; it was his noticeable and serious cognitive decline.  His physical fragility and intellectual frailty were clear.  When I voted for Biden in 2020, I thought of him as a one term president.  He should have bowed out two years in and announced he would not seek a second term.  But no.  His damn ego got in the way.  And a bunch of spineless democrats let him get away with it.  

As a result, here we are.  What is done is done, however, and now is the time to get your shit together.  First focus on getting Spanberger elected governor of Virginia this November.  It will be a bellwether.  Second, focus on mid-terms and the races you can win.  For instance, John McGuire (R) of Virginia’s 5th congressional district is an easy mark given his capitulation to Trump and his support for rolling back Medicaid, Medicare, and food aid, while lining the pockets of millionaires and billionaires.  Enough said.

There were some positive notes.  In a tie vote at the Supreme Court, after Justice Barrett recused herself, the Louisiana Supreme Court’s decision to not permit a religious-based charter school to receive taxpayer funds, stands.   Additionally, a federal judge ruled that shutting down and dismantling the U.S. Institute for Peace was illegal.  The judge even ordered DOGE not to trespass on the grounds of the Institute. 

Overall, Trump amped up the use of ‘arbitrary terror’ to punish, discipline, and silence dissent.  That is to create a climate of fear where most people, as Hannah Arendt wrote in The Origins of Totalitarianism in the aftermath of World War II, are “perfectly obedient” to government dictates.    

If you think about it, a plurality of Americans live in an autocratic state now.  A state of mind, that is.  House Republican hold outs to the ‘big, beautiful bill’ were summoned to the White House.  I don’t think tea and crumpets persuaded them to abandon their principles.  It you are obedient to Trump’s impulses out of fear, you already live in an autocracy.  I am not speaking to liberals or progressives; I am speaking to MAGA Republicans.  It is you that live in an autocracy.  I am as free as bird and think, say, and write what I damn well please.

“Hands Off” Louisa, Virginia Rally

As part of nation-wide Hands Off protests and rallies, residents of Louisa, Virginia, assembled at the Court House steps this Saturday to add their voices to a growing chorus across America, and the world, excoriating Trump’s attacks on democracy.

Organized by the Louisa County Democratic Party, the rally was one of the largest gatherings, as I understand it, in memory. The diverse and enthusiastic participants focused on wide ranging issues: Constitutional rights, Education, Healthcare, Human and Civil Rights, Immigration, Justice, LGBTQ rights, Social Security, and Veteran Services. This wasn’t a one issue rally.

Boos and Jeers for Trump

Speeches, songs, and chants filled the Court Houses front steps from noon to two. Homemade signs expressed patriotism and anger. A number of speakers derided Trump’s attacks on democracy and also on our congressional district’s representative John McGuire (R) lack of honesty and integrity in the face of constituent questions.

Speakers repeatedly called to protect social security, medicare, and medicaid –which assists Americas most vulnerable populations — from being cut to fund trillions in taxes cuts for the millionaire class. Boos and catcalls followed mentions of Trump’s tariffs. One speaker addressed the serious threats to veterans and their health services because of massive layoffs and program cuts at the Department of Veterans Affairs. Trump, Musk, and McGuire the villains of the day.

A number of participants volunteered to speak to the assembled crowd. One told of his still living mom’s experiences in Nazi occupied France — she was 11 when they invaded — and her fear that America is heading towards fascism. I can relate to that as my mom and her family lived under Nazis occupation as well. She sees parallels today.

DOGE gets to Audit State Voter Rolls in New Executive Order:  Right to Vote in Mid-Terms Threatened?

Yesterday Trump signed an executive order permitting the federal government to regulate federal elections at the state level.  The order, entitled “Preserving and Protecting the Integrity of Elections” not only violates the constitutional prerogatives of Congress and the States to regulate and run elections respectively, but repeats timeworn jeremiads of Trump’s favorite election fraud conspiracies.  

The courts should and will issue a pause or injunction because of its blatant unconstitutionality. Bizarrely, it permits DOGE to access state voter rolls to conduct audits.  Yes, DOGE, that extralegal secretive government organization run by an unelected billionaire.  Will any notification of suspension of voting registration come with a Tesla flyer? If you don’t believe me here is the language in the order:

“the Department of Homeland Security, in coordination with the DOGE Administrator, shall review each State’s publicly available voter registration list and available records concerning voter list maintenance activities as required by 52 U.S.C. 20507, alongside Federal immigration databases and State records requested, including through subpoena where necessary and authorized by law, for consistency with Federal requirements.” 

Setting the constitutionality of the order aside, it underscores Trump’s disturbing mindset and the fantasy world his legal advisors live in.  Every day it’s like going down Alice in Wonderland’s rabbit hole into a fantastical White House of gibbering lunatic imbeciles.

This is one of the most undisguised attempts to purge millions of registered voters since the end of Reconstruction.  Sowing chaos into the mid-terms is its goal. If America’s past is precursor, DOGE’s audits no doubt will target primarily black and brown voting districts.  Regardless, if you are a registered voter fear losing the right to vote.

Leading the list of abuses this week was Trump’s unconstitutional declaration of war and invocation of the Aliens Enemies Act of 1798; timed to the mass deportation of 200 plus alleged Venezuelan gang members to El Salvador and indefinite imprisonment in a maximum security prison with a history of human rights abuses.

Compounding this mass injustice was Trump’s call to impeach the federal judge who ordered a stop to the illegal deportations, cancelation of flights, and return of flight already in the air. This judicial order — in reality invoking Habeas Corpus a legal right that goes back to the Magna Carta — was ignored. The government lawyers even had the audacity to claim that it was too late because flights were over international waters by the time the written order was received even though the judge had orally ordered the stop earlier in court to the lawyers. Ironically, the flights were over the Gulf of America. How symbolic of how low Trump has sunk.

Rep. Jim Jordan has already planned hearings regarding the judge’s legal rulings. Elon Musk made max donations to members of Congress friendly towards the idea of impeaching judges who rule against Trump.

This is what happens after years of right wing rhetoric turning migrants into criminals. We know nothing about these men because they were disappeared without due process, the right to counsel. They had become unworthy victims in the eyes of too many Americans. I get rights, you don’t. That is not how American works. I think someone famous once said, “You shall do no injustice in court. You shall not be partial to the poor or defer to the great, but in righteousness shall you judge your neighbor.”

Of course Trump’s speech to the assembled staff of the Department of Justice where he rallied against the illegal press is of note. This attack on the press and free speech by a sitting President at the Justice Department is unprecedented.

Of additional note, is that government lawyers have determined that the Aliens Enemies Act permits government agents to enter homes without warrants. I presume under some Frankenstein interpretation of the ‘hot pursuit doctrine’ permitted by the Supreme Court. This determination would be in conflict with the bill of rights 4th Amendments protections from government intrusions and seizures without warrants. It suggests a government inching closer to declaring martial law.

It was a busy week with push back by the courts. Of significance was the apparently warrantless arrest of a legally permanent resident of Palestinian origin for national security reasons. He was arrested in NYC but moved to a detention facility in Louisiana and denied access to legal counsel. Two additional search warrants were executed yesterday (or today) at Columbia University by DHS agents.

Additionally, Trump requested the Supreme Court overturn three district judge rulings staying the implementation of his Birthright Citizenship ban. If the Supreme Court sides with Trump this would nullify the 14th Amendment and fundamentally alter how we as a nation think of citizenship. Very dangerous moment in America.

    • Trump on social truth threatens to cut funding for universities and colleges that don’t crack down on protests/free speech.  $400 million Columbia university.
    • Bank accounts frozen by DOJ of NGOs receiving funds from the Greenhouse Gas Reduction fund at the request of EPA admin who labeled these groups as “left wing.”  Eight recipients bank accounts frozen.  A Fed prosecutor resigned, saying she has been pressured to launch a criminal investigation despite a lack of evidence of wrongdoing.

    • The acting director of the Cybersecurity and Infrastructure Security Agency paused “all election security activities” pending the results of an internal investigation (?).  All funding to the Election Infrastructure Information Sharing and Analysis center was cut.  This center helps state and local officials monitor, analyze, and respond to cyber-attacks targeting the nation’s election hardware and software.  Critical CISA election protection staff targeted for termination.

    • Birthright citizenship executive order would impact suffrage

    • North Carolina Supreme Court judge election:  Riggs, a Democratic justice defeated Republican challenger by 734 votes, a vote tally confirmed by two separate recounts.  Republican Griffin filed numerous legal challenges seeking to throw out more than 60,000 ballots. 
    • Trump attempt to take control of FEC and other independent agencies
    • Birthright citizenship would throw voter rolls into chaos and reduce voting rolls by tens of millions.  
    • Federal bill to require proof of citizenship when registering to vote and updating voter registration reintroduced 2025.  Safeguard American Voter Eligibility Act or the SAVE Act.

Separation of Church and State, Religious Freedom

Supreme Court said States that provide taxpayer funded vouchers to private schools must also provide said vouchers to religious school students (2020).  In 2022 the Court again ruled in another case that the State could not restrict such funds within the school, that is fence off the voucher money to pay for religious instruction and worship.

State Governments establishing Christian studies, symbols, and objects at Public Schools to the exclusion of other religions 

  • Oklahoma: incorporate bible into the curriculum but no other religions’ texts.

Louisianna requires public schools display the ten commandments but no other religions’ tenets. 

Lifeboat:  A recap of John McGuire’s call-in Town Hall

Representative John McGuire of Virginia’s 5th Congressional District held a call-in town hall meeting recently.  I don’t know how many folks attended the town hall, but I do know that when folks were selected to ask McGuire questions the majority queried him about Medicaid cuts and DOGE. Funny, no talks of eggs.

McGuire started the town hall by asking listeners to participate in a poll.  The first question was, “do they want to root out waste, fraud, and abuse? “ That’s like asking Medieval folks if they want to root out Black Death, the plague.  Of course they did.  It’s the methodology that they had quibbles over.  In 17th century England, if a household member got plague, the whole household was locked inside the house for 30 or 45 days, a guard posted outside.  That quarantine was extended as other household members sickened and died.  Normally, everyone perished.  Sounds a bit like DOGE’s methodology regarding USAID and lifesaving anti-viral drugs for millions of Africans. 

But back to the town hall.  The first question McGuire was asked sounded the alarm about the proposed $880 billion dollar cut to government agencies overseen by the energy and commerce committee.  This would entail massive cuts to Medicaid, the caller thought.  McGuire’s response was to happily, almost joyfully, point out that Medicaid was not mentioned once in the proposed budget blueprint.  Duh!  The New York Times reported that if the committee cut all other non-safety net programs under their oversight, they would still have to eliminate an additional $600 billion in funding.  That means Medicaid would be hit….hard.

Another caller, a preacher, pointed out that 24 percent of his district receives Medicaid.   I asked myself, did it ever dawn on McGuire to ask himself, “why do so many folks who work full-time jobs in my district can’t afford medical insurance or care? “ Piss poor wages dude!  Nationwide, over 64 percent of Medicaid recipients work.  In Louisa County, 17 percent receive Medicaid, and this is in a county where unemployment is just a smidge over 2 percent. According to Virginia law, if Medicaid expansion funding from the Federal government drops to a certain level, the program is abandoned.  Yes, abandoned.  That would mean 600,000 Virginians would lose access to health care, many of whom are kids.  Later callers, it was clear, weren’t buying McGuire’s Trumpian responses.

The same went for DOGE.  Near universal condemnation of DOGE’s chainsaw approach, many pointing out its cold-heartedness.  One caller, from the Charlottesville area, said folks in her organization – which she specified — were worried about the haphazard cuts and potential cuts to come.  In perhaps a Freudian slip, McGuire spoke of her position and organization in the past tense.   Which he corrected quickly.  I am sure that that slip was noted by listeners.

During overwhelmingly negative comments and questions regarding DOGE’s incompetence and draconian Medicaid cuts, McGuire’s aid interjected and offered an email question.  The email question was quite flattering of McGuire.  Really, were not dumb!

Overall, McGuire got an earful, but I don’t think he listened.  Too often he used rehearsed and prepared talking points (you heard papers shuffling) instead of genuine concern.  Given the tenure of other town halls I seen or heard about, I was surprised at how calm the questioners were.  Very civil, very polite, but direct as well.  McGuire was civil himself, but too often resorting to the same phrase, saying, ‘I still love you even though we disagree.’  

I think McGuire forgot a cardinal rule in politics:  He forgot who he works for.  We expect our politicians to omit and lie and obfuscate, but we don’t expect them to work against our interests.  It was obvious he works for Trump and not us.  Ben Franklin at the Constitutional Convention in Philadelphia in 1787 said it best I think:  “In free governments, the rulers are the servants, and the people their superiors and sovereigns.”

You may be wondering why Lifeboat” is in the title of this essay. I remember as a kid watching a black and white war movie telling the story of the survivors of a torpedoed merchant ship.  The drama takes place in the overcrowded lifeboat: too many people, not enough space, too little food or water.  As time passed people died or were killed.  I realized later with age and little bit of wisdom, that the lifeboat was a parable about class and society.  The passengers represented a spectrum of society:  a wealthy socialite, working class ship hands, upper class passengers, the young and elderly, a vulnerable woman with a dead child, an enemy portrayed by the German U-boat captain. Conflicts ensued as resources, and hope, dwindled.  Winners and losers.  Everyone dead or morally tainted.

That’s the paradigm that sticks in my mind when I think of politics in America today.  America the Lifeboat.  Billions, tens of billions in cuts to Medicaid and other safety-net programs — mostly to working class folks – to pay for $4 trillion in tax cuts, the bulk of the dollars going to the wealthiest Americans.   I think that’s not the ‘golden age’ most folks who voted for Trump envisioned or want.

The Faceless Bureaucrat: DOGE and the war on the Career Civil and Foreign Services

Let me start with the proposition that DOGE’s war on the career civil and foreign services is not about waste, fraud, and abuse. It is about removing obstacles to rule by edict by an imperial Presidency. It is about undermining the rule of law.

When pressed for examples of gross government abuse by petty bureaucrats during a phone-in town hall, all Virginia representative John McGuire, a first term Republican from my district, could muster was a federal grant to study cat cannibalism. I did not fact check completely, however, but the study he referenced may have been the same cat experiments reported by the media in 2016, and stopped. .Not exactly the jaw dropping example I expected. In fact, his example undercut his argument greatly about DOGE’s effectiveness.

Hunting down waste, fraud, and abuse is a red herring. The goal is to turn faceless federal bureaucrats into scapegoats, criminals, lazy, unqualified, fat cats, who lounge all day at home in their pajamas while living large off the teats of taxpayers. The fact is the vast, vast majority are hardworking, patriotic, folks, many of whom risk life and limb. Let me tell you about four faceless bureaucrats that I worked with:

The first, a classmate and fellow special agent, was returning home from war-torn Beirut to be a groomsman in another classmate’s Christmas holidays wedding.  He died over Lockerbie, Scottland along with another agent on PAN AM flight 103.  Another colleague and friend of mine died in Baghdad during a rocket attack.  A year later, a fourth colleague died in Mosul when his motorcade was hit by a complex attack followed by a vehicle borne suicide bomber.  Another colleague was in Benghazi when the Ambassador and a communications officer died during an attack on the consulate. He evacuated to another complex and was on the roof defending the complex when a mortar round exploded nearby, concussing him, one leg tethered to his by by shards of skin. He survived. I came to know him as he recovered in hospital. All of them are patriots, they were all veterans, they answered their countries call to serve. They all had families. Till now they were all faceless bureaucrats to you. We knew them, we honored them, we served with them. f

Faceless bureaucrats like these go to work everyday in America and around the world, in every cline, facing every possible danger. Scientist virus hunters in the Congo, climatologists in Antartica, Hot Shot jumpers going into fight massive forest fires, special agents fighting cartels in Mexico with their Mexican counterparts, park rangers rescuing or searching for lost or missing hikers in inhospitable terrain and conditions.

Faceless bureaucrat are a target of DOGE because a non-partisan career civil and foreign service are an important component of a liberal democracy. They are a bulwark against illegal and unconstitutional acts and orders. They swear an oath to defend the Constitution, their loyalty is to the people. They are essential to maintaining the rule of law, not man.
